SignSparkAI Terms of Service

These Terms of Service (“Terms”) govern your use of SignSparkAI, including the website at https://signsparkai.com, the SignSparkAI application, and related services (collectively, the “Service”).
SignSparkAI is operated by SureFire Signs Inc., 1025 W Innovation Drive, Kearney, MO 64060 (“SignSparkAI,” “we,” “us,” or “our”).
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms.
1. The Service
SignSparkAI is an AI-powered creative service designed to help users create advertising graphics for LED signs and displays.
The Service may include features such as AI-generated advertising creative, exact LED sign size and aspect-ratio support, saved sign sizes and saved designs, Brand Kit information, Create From My Photo, alternate ideas and design updates, adaptation to another sign size, LED-ready image downloads, subscriptions, credits, account management, and billing tools.
Features may change over time.
2. Accounts
You may be required to create and sign into a SignSparkAI account to use paid or account-based features.
You are responsible for providing accurate account information, maintaining the confidentiality of your password and account credentials, activity that occurs through your account, and promptly notifying us if you believe your account has been accessed without authorization.
You may not use another person’s account without permission.
3. Subscriptions and Billing
Certain SignSparkAI features require a paid subscription.
Subscription prices, included credits, available features, and applicable rollover limits are displayed in the Service or during checkout.
Subscriptions automatically renew unless canceled before the next renewal date.
Payments are processed through a third-party payment processor. SignSparkAI does not store full payment-card information.
Additional billing, cancellation, credit, and refund rules are described in the SignSparkAI Refund & Cancellation Policy.
4. Credits
SignSparkAI uses credits for certain creative operations. Different operations may require different numbers of credits.
Credits are provided for use within the Service, do not have cash value, cannot be redeemed for cash, cannot normally be transferred between customers, and are subject to the limits, rollover rules, expiration rules, and feature requirements of the applicable subscription plan.
A completed creative operation that produces a usable result may consume the applicable credits even if you decide not to use that particular result.
If a confirmed technical failure deducts credits but no usable result is delivered or recoverable through the Service, SignSparkAI may restore the affected credits after reviewing the transaction.
5. AI-Generated Content
SignSparkAI uses artificial intelligence to generate and modify creative content.
AI-generated results can vary from one request to another. SignSparkAI does not guarantee that every generated result will meet every customer preference.
You are responsible for reviewing generated content before using or publishing it, including checking names, prices, dates, phone numbers, offers, logos, trademarks, factual statements, and other important information.
You should not rely on SignSparkAI as the sole source for verifying business, legal, pricing, promotional, or factual information shown in an advertisement.
6. Customer Content and Uploaded Materials
You may provide prompts, logos, business information, images, photos, and other materials to the Service (“Customer Content”).
You represent that you have the rights or permissions necessary to provide and use Customer Content through the Service.
You retain your rights in Customer Content.
You authorize SignSparkAI and its service providers to process Customer Content as reasonably necessary to operate the Service, generate requested creative, provide account features, maintain saved designs, provide support, and protect the Service.
For Create From My Photo, the original customer-supplied source photo is intended to be temporary session input. The source photo may be processed during the active session so that related creative operations can use it, but the original uploaded source photo is not intended to be stored as a permanent saved design or retained in long-term account storage. Finished generated designs and related account metadata may be saved to the customer’s account.
7. Saved Designs
SignSparkAI may allow customers to save generated designs and related information to their account.
Successful creative versions are generally preserved as separate designs rather than automatically overwriting prior successful versions.
Storage limits may apply. If an account reaches an applicable design-count or storage-size limit, SignSparkAI may require the customer to delete older designs before creating or saving additional designs.
SignSparkAI may use reasonable technical safeguards, compression, storage limits, and account-size limits to maintain reliable operation.
8. Brand Kit
Brand Kit may allow you to provide logos, colors, business information, and other brand materials.
You are responsible for ensuring that you have permission to use materials supplied through Brand Kit.
AI-generated placement, layout, and interpretation may vary. You should review branded creative before use.
9. Acceptable Use
You may not use SignSparkAI to violate applicable law; infringe intellectual-property, privacy, publicity, or other rights of another person or organization; impersonate another person or business in a misleading or unlawful manner; submit material you do not have the right to use; interfere with, damage, reverse engineer, probe, overload, or disrupt the Service; attempt to bypass subscription, credit, account, or security controls; engage in fraud, payment abuse, chargeback abuse, or other misuse of the Service; or use the Service in a way that could expose SignSparkAI, its service providers, or other users to unlawful activity or material harm.
We may suspend or terminate access where reasonably necessary to address fraud, abuse, security issues, unlawful activity, or material violations of these Terms.
10. Third-Party Services
SignSparkAI relies on third-party service providers for portions of the Service, which may include payment processing, cloud hosting and storage, transactional email, and artificial-intelligence processing.
Third-party services may experience interruptions, delays, changes, or failures outside SignSparkAI’s direct control.
Your use of certain third-party functionality may also be subject to the applicable provider’s terms and policies.
11. Availability and Changes
We work to provide a reliable Service, but uninterrupted or error-free operation is not guaranteed.
We may modify, improve, suspend, discontinue, or replace features when reasonably necessary for product, security, technical, legal, or business reasons.
We may also update subscription features, credit requirements, storage limits, or pricing. Material pricing changes will apply as communicated in connection with the applicable subscription or renewal.
12. Intellectual Property
The SignSparkAI name, software, interface, workflows, prompts, systems, branding, and other proprietary elements of the Service are owned by or licensed to SureFire Signs Inc. and are protected by applicable intellectual-property laws.
These Terms do not transfer ownership of the SignSparkAI Service or its underlying technology to you.
13. No Guarantee of Advertising Results
SignSparkAI helps create advertising creative, but we do not guarantee any particular business, advertising, sales, traffic, engagement, or financial result from using generated content.
You remain responsible for deciding whether and how to publish or display a generated advertisement.
14. Disclaimers
To the extent permitted by law, the Service is provided on an “as available” basis.
AI-generated content can contain errors, omissions, unexpected design choices, or inaccuracies. You are responsible for reviewing content before use.
Nothing in these Terms limits rights or warranties that cannot legally be excluded.
15. Limitation of Liability
To the extent permitted by applicable law, SignSparkAI and SureFire Signs Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the Service.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
16. Cancellation, Refunds, and Account Termination
You may cancel a subscription through the available billing-management tools.
Cancellation, refund, credit-expiration, and billing-error rules are governed by the SignSparkAI Refund & Cancellation Policy.
If an account is terminated because of fraud, abuse, unlawful activity, chargeback abuse, or a material violation of these Terms, refunds may be denied to the extent permitted by law.
17. Privacy
Our collection, use, processing, storage, and disclosure of personal information are described in the SignSparkAI Privacy Policy.
18. Changes to These Terms
We may update these Terms from time to time.
When we make material changes, we may provide notice through the Service, by email, on the website, or through another reasonable method.
The updated Terms will apply from the stated effective date.
